Whilst I'm not going to be of much use I can tell you that I currently experience the very same problem with the new A4 (2008), to the letter in fact. Sometimes the car just refuses to lock either by touching the sensor on the driver's handle or the remote - I often just give up, leave the car unlocked and go back and lock it later - refusing to embarrass myself in front of the neighbours!

It definitely shouldn't be a battery issue as it did this from new. Sometimes, I found whilst sitting in the car that the car told me the key wasn't present in the vehicle, even though it was. I resolved this by removing the remote for my other car (Toyota) from the key ring - I can only presume some electronics 'got in the way'.

Anyway, if the problem persists I will approach my Audi dealer and see what excuse they come up with - I'll be sure to let you know.
